Registration number in the Tourist Registry of Catalonia

According to Law 2/2014, of January 27, fiscal, administrative, financial and public sector measures, published in the Diari Oficial de Catalunya, number 6651 dated 01/30/2014, have added section 5 in the article 73 of the LLei de Turisme de Catalunya, where the following is requested:

"The registration number in the Tourist Registry of Catalonia of companies and tourist establishments must be included in all types of advertising to be announced." Our registration number in the Tourist Registry of Catalonia is HG-001768.

These terms and conditions are subject to the provisions of Law 7/1998 of 13 April on General Contracting Conditions (LCGC), Law 26/1984 of 19 July, General Law for the Defence of Consumers and Users, Directive 97/7/EEC of 20 May 1997, which applies to contracts made online between consumer and provider, and other legal provisions.FORTACO SL acts on behalf of HOTEL ACAPULCO LLORET, company that holds the required permits and licenses for said activity.
These general terms and conditions shall only apply to final customers.
The above general terms and conditions constitute a contract with FORTACO SL through the www.anabel.cat website for booking accommodation. Please read the following terms and conditions and make sure you understand them before booking. These terms and conditions apply to all bookings made with FORTACO SL as well as all those for whom the booking has been made. FORTACO SL acts as agent for and on behalf of the hotels and apartments on this site. FORTACO SL reserves the right to modify these terms and conditions at any time without prior notice or warning, and the provision of this service is therefore limited to the time the user is connected to the website or any of the services that are provided through the same.
By placing a reservation you acknowledge that you have read, understood and accept these terms and conditions. We ask you to please contact us if there is some aspect of the general terms and conditions that you have not completely understood or that raise any questions or doubts.

1. Book a room

The user must follow the instructions and complete the sections indicated in this website’s booking engine and make payment under the terms set out in section 5 (PAYMENT CONDITIONS) of these terms and conditions.
Cancellation fees shall be in effect once the booking has been made. FORTACO SL shall provide proof of payment that the guest should print and show to the hotel upon arrival. 
It is essential that you check that all your booking details are correct on the printable voucher.

2. Liability

If the booking is made for two or more people the person making the booking must be authorised to represent all those included in the booking and assumes liability for payments made on their behalf, including cancellation fees and charges arising from corrections or modifications. He/she shall also inform all those included in the booking of the booking details and any other relevant information. Make sure that all personal data provided during the booking process is correct and truthful.

3. Legal age

The user confirms that he/she is of legal age (18 or older) and has the legal capacity to enter into this agreement and to use this website in accordance with the terms and conditions set forth herein, which the user understands in their entirety. If you are under 18 and are travelling with adults other than your parents or guardians, they must assume responsibility for the booking and all liabilities and expenses arising from the same.

4. What services are included?

The terms and conditions for each service (rates, products, availability, cancellation or change to the reservation conditions) are established by the accommodation provider.
Services include:

  • The accommodation and meal plan indicated in the booking confirmation that is given to the guest when the booking is made.
  • Indirect taxes (VAT, IGC – global complimentary tax) when applicable.

Services not included:

  • Transfers/assistance to or from the hotel or similar.
  • Optional outings or tours.
  • Additional room charges, food and tips for services not listed in the booking.
  • Fees that the hotel or apartments set for lounge chairs, sports equipment for playing tennis, bicycles, access to sports facilities like the gym, spa, etc. and any other.
  • Deposits required by the hotels or apartments that you have booked.
  • Any other service not included in the booking confirmation.
  • Tourist tax applied by the Autonomous Government of Catalonia.

5. Payment conditions

As a general rule the user can choose between two payment methods:

  • Pay directly at the hotel. In this case, you will have to leave your credit or debit card details as a deposit.
  • Full payment online with credit or debit card. In this case, you must pay the full amount when making the booking.

However, FORTACO SL informs the user that there may be special rates for certain booking dates, or particular conditions of any of the hotels, which may require the online payment of the full booking amount as the only valid payment method.
For this purpose, you can use any the credit cards indicated during the booking process.

6. Complimentary services

When users’ request and pay for supplementary services that they were not able to definitely confirm through our website and that are ultimately unavailable, FORTACO SL’s liability shall be limited to a refund of the amount paid for said services.

7. Booking cancellation and modification

Upon receipt of your confirmation, FORTACO SL  is committed to providing its customers all contracted services as best as possible. The accommodation rate may be recalculated for the new occupancy in the event that the number of people included in the booking changes. For example, a vacancy occurs in the event that the number of people for which the booking is made is reduced and, consequently, each remaining person included in the booking may pay an extra charge, in which case payment for the extra amount must be made directly to the hotel or apartment.

Should you wish to make any changes while staying in the hotel or apartment, such as extend your stay, the request to extend the booking period will be subject to the hotel or apartment’s availability, in which case payment for the extra amount must be made directly to the hotel or apartment.
Cancellation of a confirmed booking must be communicated by the person who made the booking in writing by e- mail or online.
Cancellation fees are calculated according to the rates below and shall be immediately communicated.

Please note that the cancellation fees indicated below refer exclusively to changes in the same hotel. If you just want to change hotels, you must contact our booking department at +34 00 972 36 54 98 or e-mail at info@hotelacapulcolloret.com to be informed of the associated cost. 
If we do not receive the e-mail cancelling your booking 72 hours prior to your arrival the hotel will charge the rate of the first night’s stay to your credit card. In the event you do not arrive and do not cancel your booking the hotel will charge the full booking rate to your credit card. If your booking is NON-REFUNDABLE, the full booking rate will be charged to the credit card at the time the booking is made.

8. Before travelling

Without exception all users (including children) must have all their personal and family documentation, be it a passport or DNI (National ID Card), current according to the laws of the country or countries they visit. When so required, the user shall be responsible for obtaining visas, passports, vaccination certificates, etc.FORTACO SL shall not be liable if any authority refuses to grant visas for reasons caused by the user or if the user is denied entry into the country for failing to meet the applicable requirements.

In the apartments, a security deposit of EUR 100 is required upon arrival for incidentals. This deposit is fully refundable upon check-out and subject to a damage inspection of the accommodation. Please note the deposit must be paid in cash.

9. Insurance

The user is hereby notified that, in accordance with the General Law for the Defence of Consumers and Users, once you make a booking we recommend that you contract health care insurance that covers repatriation costs in case of accident, illness or death.

10. Force majeure

Events of force majeure refer to (by way of example but not limited to) fire, extreme weather conditions, earthquakes, accidents, epidemics, destruction or damage to the accommodation for any reason, government decisions, war, war treaty, civil unrest, terrorist attack or any industrial or commercial activity to the detriment of FORTACO SA.

11. Claims

Despite having supervised all our accommodations it is possible that it may not be to your satisfaction. In this case, guests must notify reception or the hotel or apartment manager to try and solve the problem. If the problem cannot be resolved by notifying the staff, we hereby inform you that FORTACO SL shall not be liable for damages or losses arising from third party actions, omissions or negligence.

12. Disclaimer

The information provided on the website is provided by the accommodation providers. FORTACO SL shall not be liable for inaccurate or erroneous information or third party omissions. All other service providers operate independently of FORTACO SL and its subsidiaries and shall therefore not be considered agents or employees of the company. Thus, FORTACO SL and its subsidiaries shall not be liable for the acts, omissions, abuse or neglect of service providers, nor for any damages and costs that may arise. FORTACO SL and its subsidiaries shall not be liable in the event of overbooking or force majeure or any other cause beyond its control.

13. Compensation

You are responsible for the behaviour of the members of your group during your stay. The accommodation provider reserves the right to terminate your stay or that of any of the group members for misconduct at any time. In this case, the corresponding cancellation charges shall apply in full and under no circumstances shall there be a refund. Moreover, the accommodation provider is not obliged to pay any compensation or bear any costs or expenses you may incur due to the early termination of your stay for the reasons detailed above. If your actions or those of any member of your group result in damage to the property where you are staying, you agree to compensate us (including legal fees) for any claim that might be made by the owner. Finally, are you also required to reimburse the accommodation provider for any damage caused before finalising your stay.

14. Check-in and check-out

Check-in starts at 14:00 p.m. and check-out is at 12 AM.

15. Applicable law

These general terms and conditions are governed by Spanish law and the parties submit to the courts of Blanes (Girona) in case of dispute.
