General contracting conditions

1. PARTIES AND ACCEPTANCE OF THE GENERAL CONTRACTING CONDITIONS:

(hereinafter also the General Conditions or CGC):

On the one hand, the provider of the management of accommodation reservations in FORTACO, S.L., (hereinafter also the provider and HOTEL ACAPULCO), with registered office at C / Josep de Togores 21, 17310, Lloret de Mar, N.I.F. B17120445, customer service telephone number 972 36 54 98, and e-mail: info@hotelacapulcolloret.com, being the owner of the website www.hotelacapulcolloret.com, exposes the contractual document that will govern the contracting of hotel room reservations through of the reviewed website.

And on the other, the User - Client (hereinafter the User), who makes the reservation and is responsible for the veracity of the personal data provided to the provider.

BOTH Accept this document, and it implies that the user:

That you have read and accept these general conditions of purchase from the moment you make any reservation.

These conditions will have an indefinite validity period and will be applicable to all contracts made through the provider's website www.hotelacapulcolloret.com.

The provider reserves the right to unilaterally modify said General Conditions, without this affecting the reservations or promotions that were acquired prior to the modification, in order to improve the services offered. In any case, before booking these general conditions must be consulted.

It is advisable that you keep a copy of the information contained in the reservation process. HOTEL ACAPULCO is not responsible for any loss of data, files or any damage resulting from a failure to backup by the User of the data contained in the reservation made.

The civil liability of HOTEL ACAPULCO for the services provided is limited to the amount thereof, the user renounces to claim any responsibility to HOTEL ACAPULCO for any concept in any case of dissatisfaction of the services acquired on the web www.hotelacapulcolloret.com, as well such as possible failures, slow access or errors in accessing the web, including loss of data or other types of information that may exist on the computer or network of the user who accesses the web www.hotelacapulcolloret.com.

HOTEL ACAPULCO offers remote hotel room reservations online through its website or in person at the hotel facilities at C / Josep de Togores 21, 17310, Lloret de Mar.


2. OBJECT OF THE CONTRACT:

2.1 Scope of application: The purpose of this contract is to regulate the contractual accommodation reservation relationship involves the reservation of the chosen room, for a limited time, in exchange for a specific price and publicly exposed through the website. 3. INFORMATION PROVIDED ON THE WEB www.hotelacapulcolloret.com:

3.1 Publication of prices: The prices of the rooms are those shown in the information of each one of them on our website www.hotelacapulcolloret.com.

There are reservation modalities that offer discounts or benefits at the time of cancellation and that we will detail:

Flexible mode: this mode offers a 10% discount on the reservation and a totally flexible cancellation policy up to 15 days before your arrival. Cancellation is detailed in section 8 of these conditions.

Discount that will be applied in the purchase process. This modality requires paying 30% of the total amount 15 days before the reservation date.

Long stay modality: reservations of more than 5 nights are considered as long stay and this modality offers a 10% discount on the reservation. Discount that will be applied in the purchase process.

The prices of the extra services are shown at the time of booking. The details of the cancellation modalities are set out in the room information and in section 8 of these conditions.

3.2 Information about the rooms: The information that appears in our advertising, brochures, other written material, on our website or that provided to you constitutes an invitation to make a purchase. The contents of www.hotelacapulcolloret.com are constantly renewed and updated to offer our clients the most complete and detailed information possible. All the contractual information present in www.hotelacapulcolloret.com is shown in Spanish (Castilian), Catalan, English, French, Russian and German and communication with customers and users, as well as the formalization of the contract, can be carried out in any of these languages.

3.3 Availability of the room(s): The published rooms are available. the room in question is visible but not available for reservation.

3.4 Reservations 24 hours a day, every day of the year: The hotel is open to the public seasonally. The opening period in 2021 will be from 06/18/2021 to 10/18. The schedule for receiving reservations for those dates via the web is twenty-four (24) hours 365 days. Once the reservation is made, you will automatically receive an email confirming the process and another confirming the purchase when the provider has received and confirmed the payment corresponding to the amount of the reservation.

3.5 Fraud: If HOTEL ACAPULCO suspects or detects any anomaly or fraud, it reserves the right to cancel the transaction for security reasons.


4. RESERVATION PROCEDURE:

In order to access the services offered by the provider, the user must not register through the website by creating a user account. You will only be asked for the essential data to be able to process your reservation.

Once you have selected the room (s) you wish to reserve, it is reported that in accordance with what is required by art. 27 of Law 34/2002 on Services of the Information Society and Electronic Commerce, the contracting procedure will follow the following steps:

If there is any type of error in the indicated address or in any other point of the reservation, you must notify it immediately to the e-mail address indicated above in order to correct this error.

5. RESERVATION CONFIRMATION

The PROVIDER will reserve the room under the payment conditions.

At the time of completion of the online reservation, we will send you to the email address you provided when making the reservation and the payment conditions and reservation details.

6. PRICES AND DEADLINES OF VALIDITY OF OFFERS:

All prices displayed in the www.hotelacapulcolloret.com store include the VAT in force at the time of booking. All the prices that appear on the web are valid and will be expressed in the Euro currency (€). Said expenses, unless expressly indicated otherwise, do not include cancellation costs, nor do they include tourist taxes and / or travel insurance.

The user will receive the reservation invoice to the email address provided by the user once the reservation is made.

The prices applicable to each accommodation rental will be those published on the web and applied automatically by the contracting process in the last phase of the same.

In the cases of promotions of limited duration, the promotion discount will be applied as long as the reservation has been registered during the promotion period.

The data recorded by the different payment methods constitute proof of the date on which the financial transactions were made and will serve to determine whether or not said reservation is subject to promotion.

For any information about the reservation, the User may contact the provider through the customer service telephone number or via email at the address provided.


7. PAYMENT METHODS

Below, we detail the available systems:

7.1 Payment by credit or debit card: The user must have a valid credit or debit card, where they must specify all the digits of the card number in the corresponding form. The operation is formalized at the time of placing the order. We only accept payments with secure cards in which your identity as the cardholder is authenticated according to the method established by your bank, through secure electronic commerce ("Verified by Visa" and "MasterCard SecureCode"). The order cannot be taken into account and will not be processed until the payment has been authorized by your bank or box.

The system called SSL (Secure Sockets Layer) is used, a payment system in a secure environment since it allows the encryption of the information transmitted during the transaction, ensuring its confidentiality.

7.2 Payment by transfer or deposit to account: At the time of finalizing the order, the user will receive the instructions with the account number to pay for the order. It is essential that the assigned order number and the name of the user are clearly indicated in the transfer order. In order to confirm the order, it will be necessary to carry it out within 7 days, otherwise it will be canceled in our system.

7.3 PayPal: Once the purchase is completed, if you choose this form of payment, you will be redirected to the official PayPal website where you can make the payment. Once the payment has been made correctly, your order will be finalized and an email will be sent with the summary of your purchase. Pressing the button "Back to the web" will return to the web to see the order and to be able to print it.

PayPal automatically encrypts confidential data using the most advanced technologies available on the market. PayPal has its own privacy policies and HOTEL ACAPULCO does not have any type of responsibility for them.


8. CONDITIONS OF CANCELLATION AND PAYMENT

The right of withdrawal will not be applicable to contracts that refer to the supply of accommodation services for purposes other than housing if the contracts foresee a specific date or period of execution.

The cancellation of the reservation can occur in three different modalities according to the selected rate and type of reservation made:

The flexible rate: if you cancel 15 days before your arrival, a deposit of 30% of the reservation will be charged. If you finally cannot enjoy the reservation, a voucher is generated that expires in 36 months.

Best available rate: you can modify or cancel the reservation up to 24 hours before arrival and nothing will be paid until you reach the hotel. If you cancel in the previous 24 hours, 50% of the total amount of the reservation will be charged.

Long stay: if you book a long stay reservation (it is considered a long stay from 5 nights) you can cancel your reservation until the day before your arrival.

Cancellations must be requested in writing by email to info@hotelacapulcolloret.com.

If the reserved accommodation is not occupied on the day of arrival or at the latest on the following day before 12 noon, the reservation will be automatically canceled, unless we have been notified in writing of the delay.

In case of delay on the day of arrival or early departure in any modality, 100% will be charged, unless there is an agreement between both parties.


9. CONDITIONS OF THE STAY

Arrivals: The accommodation can be occupied on the day of arrival from 2pm.

Upon arrival and in accordance with current legislation, the USER must deliver the reservation form and all occupants of the accommodation will be identified.

The tourist tax will be applied according to current legislation and will be paid at the reception upon arrival.

Departures: must be left free on the scheduled departure day before 12 a.m.

 

Extra services:

If the USER is interested in hiring an extra service, he must do so at the time of booking:

Cot: free

Late check out (until 7pm): € 30 per room.

Parking: € 10 per night.

Half board: € 6 per day per person

Full board: € 12 per day per person

Hydromassage bath: € 5 per night.

CAVA: € 12 per bottle

Therapeutic massage (25 minutes): € 28 per massage

 

Client responsibilities:

The USER agrees to respect the Hotel regulations. During the hours of rest from 10:00 p.m. to 8:00 a.m., it is not allowed to use the rooms for the purpose of party celebrations, or to make noise. In no case is it allowed to occupy the room by more people than those established in its maximum capacity.

It is forbidden to hang towels and clothes on the balcony railings.

The pool schedule is set by each Community and in general is from 9:00 a.m. to 7:30 p.m. It is forbidden to nail objects such as umbrellas, awnings, etc. on the grass, as well as using inflatable mattresses in the pool.

Children must always be accompanied by their parents and under their responsibility.

The USER is responsible for the correct behavior of all his reservation partners, otherwise, the PROVIDER reserves the right to expel the occupants of the accommodation, without the right to future claims or any type of compensation.

HOTEL ACAPULCO will not be responsible for any direct or indirect damage that may be caused as a result of the misuse of the room, including without limitation: destruction, loss after fire, theft, crime, accidents or other types of damage.

Animals are not accepted in the hotel.

The provider will not be responsible for reservation errors attributable to the user or caused by unavoidable and extraordinary circumstances.


10. NULLITY AND INEFFICIENCY OF THE CLAUSES:

If any clause included in these General Conditions is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will affect only said provision or the part of it that is null or ineffective, the General Conditions subsisting in everything else, having such provision, or the part of it that is affected, by not being placed.


11. ONLINE DISPUTE RESOLUTION:

In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online conflicts between the USER and the PROVIDER, without the need to resort to the courts of justice, through the intervention of a third, called the dispute resolution body, which acts as an intermediary between the two. This body is neutral and will dialogue with both parties to reach an agreement, finally being able to suggest and / or impose a solution to the conflict. 12. APPLICABLE LAW AND JURISDICTION:

These conditions will be governed or interpreted in accordance with Spanish legislation in that which is not expressly established. The provider and the user agree to submit any controversy that may arise from the provision of the service object of these Conditions, to the Courts and Tribunals of the provider's domicile (if it is not considered as a consumer for the purposes of the TRLGDCU) or the user (if it is considered as a consumer for the purposes of the TRLGDCU).


13. APPLICABLE REGULATIONS:

These General Conditions are subject to the provisions of:

European regulations governing electronic commerce:

Directive 97/7 / EC on the protection of consumers in relation to distance contracts (Distance Selling Directive);

Directive 2000/31 / EC on certain legal aspects of information society services, in particular electronic commerce in the internal market (Directive on electronic commerce).
